University of Portsmouth Catering Loyalty Terms & Conditions
1. These terms and conditions are applicable across the entire University of Portsmouth Catering Loyalty scheme and any participation is considered as acceptance. Additional terms and conditions may be in place for optional elements of the scheme, examples of which include seasonal events. Members participating in the optional elements of the scheme will be considered as having accepted the additional terms and conditions.
2. The Loyalty card, coupons, vouchers and points, in whatever form, are issued by and remain the property of University of Portsmouth which may, at any time, terminate the scheme or alter or amend the conditions of operation of the scheme.
3. All members of the scheme must be a staff member/student or contracted to work at the University of Portsmouth in the UK.
4. Members are only entitled to one loyalty card each. University of Portsmouth reserves the right to refuse, merge or close additional accounts at any time.
5. Members must register their personal details. University of Portsmouth cannot be held responsible for any loss of points or vouchers incurred as a result of out of date details. New accounts that are not registered within two years of first being used will be removed and any points or vouchers forfeited.
6. The loyalty card, in whatever form, is not transferable, cannot be copied and can only be used by the member who is named and registered on the card.
7. Loyalty cards and vouchers remain the responsibility of the member, as do any security details relating to the account. University of Portsmouth cannot be held responsible for any loss arising from the member failing to ensure the safekeeping of these items.
8. University of Portsmouth may decline to issue, withdraw or cancel loyalty cards, vouchers and points, in whatever form, and / or remove a member from the scheme at any time where there is reasonable belief of:
+ any abuse or attempted abuse of the scheme;
+ any breach or attempted breach of these terms and conditions and / or those relating to the optional elements of the scheme;
+ any behaviour relating to University of Portsmouth that involves theft, misconduct, abusive or offensive behaviour, or supplying false or misleading information.
9. Loyalty cards can only be used for purchases from University of Portsmouth Catering Services and promotional partners who are part of the scheme.
10. The scheme is only for personal and consumer use. Loyalty cards cannot be used for any department transactions or purpose, members found to use their loyalty card for departmental purposes may be removed from the scheme or forfeit those points collected.
11. Loyalty accounts, cards, points and vouchers cannot be transferred, bought, sold or in any way traded.
12. Members can choose to leave the scheme at any time. By leaving the scheme members forfeit the right to any points or vouchers already accrued or issued.
13. Members must present their loyalty card at the till point in order to collect points for any transaction, members who forget to present their loyalty card at this time cannot retrospectively claim for points.
14. To be awarded points, members must spend above a certain amount on qualifying products in a single transaction. The amount of points awarded may change and will vary depending on the products bought, the amount spent and where the transaction takes place.
15. Points will not be awarded for nonqualifying products, such as alcohol. Other products may also be excluded from the scheme at the discretion of University of Portsmouth.
16. Members must register their card online to redeem points, but may collect points before registering.
17. University of Portsmouth may set a limit on the number of times points may be awarded for promotional items on which additional points are available. Individual promotions may have different limits as communicated in their purchase conditions. Any participation in promotional offers above and beyond what could objectively be considered consumer behaviour or personal use may be considered as abuse of the scheme.
18. University of Portsmouth is entitled to remove points at any time if products are returned for any reason and a full or partial refund of the purchase price is given. This also applies to the exchange of products, unless the exchange is for products with an equivalent points value.
19. Points awarded at the time of the transaction or vouchers already issued may be removed or cancelled if University of Portsmouth determines that the points were collected in breach of these terms and conditions or were awarded in error. For the avoidance of doubt, any advice or actions of our staff that is contrary to these terms and conditions will not have the effect of changing these terms and conditions.
20. Points have no value, the current conversion value of points is one point equals one penny and the base collection rate is 5 points per £1.
21. University of Portsmouth is under no obligation to award loyalty points for any reason outside of qualifying transactions.
22. These terms and conditions replace all previous versions, are correct as of August 2015 and shall be governed by and construed in accordance with the laws of England, and any disputes will be decided only by the English courts. University of Portsmouth reserves the right to change these, at any time, on reasonable notice for legal, regulatory, business or policy reasons. Members who continue to participate in the scheme following such a change will be considered to have accepted the updated terms and conditions.
23. A person who is not a party to these terms and conditions shall have no right under the Contract (Rights of Third Parties) Act 1999 to enforce any term of these terms and conditions, but this shall not affect any right or remedy of a third party which exists or is available apart from that Act.
24. There is no cash alternative or value to the vouchers. We cannot be responsible for any unauthorised use of Points or any lost or stolen Vouchers.
25. In the event of a computer error University of Portsmouth will restore the last recorded unused balance to your loyalty card. If you have any queries about your loyalty card please contact loyalty@port.ac.uk.
26. You may cancel your loyalty card at any time by emailing loyalty@port.ac.uk, any remaining balance on your loyalty card will be lost on cancellation. It is therefore important that you make sure that any points on your loyalty card are redeemed at a participating outlet before you cancel your loyalty card.
27. The loyalty card holder is responsible for making sure that any information University of Portsmouth holds about you (including your name) is correct and up to date.
28. University of Portsmouth does not accept liability for lost, stolen or damaged cards. University of Portsmouth cannot be held responsible for any loss arising from a loyalty card holder failing to ensure the safekeeping of these items or any security details relating to a cardholder’s account.
29. University of Portsmouth will not use any information provided during the signup process for commercial/marketing gain.
30. University of Portsmouth may use any information you provide to us together with details on how you use your loyalty card and what you buy in our outlets to help manage/improve our loyalty card scheme.
31. Employees of University of Portsmouth Catering Services department can hold a loyalty card but they will not be eligible points on staff discounted items only full priced items, and cannot collect points during a working shift in any unit.
32. If a till is offline (no network connection) then member can only accrue points and cannot redeem points, points will be added to the members account as soon as it possible. If the till is offline for more than 5 days it may not be possible to add these points to your account.
